I'm new at this, but I read the thread about restocking fees. In NY State there are statutes that specify how/when/where merchants can charge restocking fees. However, I am now in Florida and recently ordered some flooring tile from a new company. When I got home I read the receipt and realized I had been charged $3.00 a sq.ft., not the $2.60 agreed upon with the manager. The restocking fee was printed at the bottom of the receipt, so I could not have seen it until after the credit card was charged.
I called within 48 hours and asked to cancel the purchase and have the charge removed from my card. I was given many explanations of why this couldn't happen; e.g., their credit card machine was broken, they needed me to come in personally to "swipe" the card again, and so on. Finally, when I went in person to see the salesman, he tried to deduct over $700.00 for restocking.
Please keep in mind: *I never received any tiles; the tiles never left the warehouse; how can someone "re-stock" when no stock was ever moved????*
So, my question is simply is this legal? I can't find anything in Florida statutes, just many warnings on -line that these "hidden fees" are the latest in corporate scams.
