I see it from both sides (not that you asked).
I have sent a few emails to subscribers in the past, and that's part of the reason I can't seem to force myself to keep up with my mailing lists and actually (gasp!) *mail* stuff! I *ALWAYS* got complaints, and it *really* made me nuts. It was very upsetting!! I didn't have an automated double-opt-in, but I did it manually, and still I got complaints down the road (never to my ISP, thank goodness, but VILE and disgusting complaints sent to me personally). I decided it just ain't worth it, from which sprouted my blog.
From the other side:
I subscribe to tons of things because I think they may be useful to me on my web sites or just because I'm interested. I may hate them when I really get into them, but I rarely bother to unsubscribe because it often turns out to be pure torture and more time wasted. So I get gobs of stuff I don't want -- and I don't even remember subscribing to.
I would never *dream* of reporting these people, because I figure there is a good chance I actually *did* subscribe before I realized it was nothing but a bunch of regurgitated junk or more sales pitches.
I see it as my problem, not theirs.
For the most part, it's easy to tell unsolicited spam from actual subscriptions you may have forgotten.
I still believe my pinky is my best personal defense -- and The Roadie is the best Defender Of The Masses.

Do yourself a favor and turn your legal team loose in greener pastures.
