Posted By: The Roadie <wcarton@flash.net> In Response To: How do I stop calls from MLMers?(Long Rant incl) (Larry Foster)

> Warning! This is long and partly a rant.
> I get 3-5 calls a week from nice people pursuing their dream with the
> greatest opportunity since sliced bread.
Dont'cha just hate it when that happens? :-)
> My phone # is on the Do Not Call list. When I ask where they got my name
> and phone #, some will say "I don't know". Can you believe they
> "don't know". Others will say their upline gave it to them and

And the little guys think they're not required to honor any sort of telemarketing rules if they think you coughed up your number and opt-ed in.
> Now, I have previously been in network marketing and I am not as down on
> it as some here. But, I'm tired of this.
Ahhhh, but if you were in it once, to their point of view, you're in it forever. If you're not working a program now, it's just because they haven't been able to pitch theirs to you yet. Again, I know you're annoyed - but from their trained point of view, persistence is everything.
My record for the number of repeat followup phone calls I got to a single distinctive name and throwaway number used for a refinance sting was 30. Over 14 months. Then I threw the number away and it's now disconnected, so I don't know if they're still calling.
> Some of these people respond that they are exempt from Do Not Call because
> this is business to businss.
That's actually an exemption in the telemarketing regulations. Annoyhing one, to say the least. Thank the DMA for that.
> I ask them how this is business to business
> when they are calling an unlisted personal phone#. (I do use this
> particular # for my real estate business.)
If it's published anywhere on the net or in a business directory as a business number, then you would not prevail in a lawsuit. They're still scum for pushing so hard, but isn't that what many MLM operations train the members to do?
> Also,my personal e-mail gets 8-10 solicitations a week. (That doesn't
> count the porno, viagra, preapproved mortgages and credit cards.)
Send me a few if you can guarantee they're spam. After a few of 'em lose their email accounts or web sites, word might spread that spamming you is bad for THEIR business. Make sure to preface any emails with something that says I asked you to send them, to make sure I don't cost the wrong person their account. :-)
> Most of these have a phone # to call after looking at their great online
> presentation but no remove links which I hate to use anyhow.
So the crooks are ignoring CAN-SPAM? I'm shocked, I tell you.....SHOCKED! LOL!
> If they were close by, I could hunt them down like dogs and shoot them but
> that is a bit impractical.
Severed heads on pikes is my favorite way. Then they serve as an example to others.
> Thanks in advance for any help.
One of the last guys I offered to help here said he didn't know me from a hole in the wall. As a reference, here is a posting from a network admin's newsgroup where I was able to post about a domain disconnection project where the spamming customer lost 806 domains from GoDaddy at once.
http://groups-beta.google.com/group/news.admin.net-abuse.email/msg/f84467db4bb4c267?dmode=source
That's a personal best day's work. :-) My first two years spam-tracking only got me 1200 disconnections. Spammers seem to be getting stupider as they grow more of them.

PLEASE READ THIS LEGAL NOTICE CAREFULLY BEFORE YOU FILE A LAWSUIT OR EVEN WASTE TIME THINKING ABOUT IT. It has been done before, but never successfully. In fact, the last dodobird who tried it ended up being ordered to pay more than $77,000 in attorney fees ($65,000+ to my attorneys and $12,000+ to my co-defendant's legal advisor).
If your attorney is worth his salt, he's going to tell you that the expense of filing a lawsuit you can't win is a whole lot worse than any "damages" resulting from messages posted on this insignificant little chunk of cyberspace. NEWS FLASH: I didn't just climb down off that ol' turnip truck yesterday. I'm well aware that expressing a negative opinion, relating one's personal experience, and restating provable facts are all legal in this country and do not constitute libel, slander, or defamation -- so you don't want to play games with me, and you sure don't want to start something you aren't prepared to finish. I don't take threats lightly, and I don't accept bribes (or did you call it a "mutually-beneficial arrangement"?). I'll turn you in faster than you can yell, "ARREST ME, I'M SCUM!!" Do yourself a favor and turn your legal team loose in greener pastures. Although we may, from time to time, monitor or review discussions, postings and the like on the Friends In Business (Scams 101) Message Board, we are under no obligation to do so. You are likewise prohibited from posting any false claims against any company or individual. If you cannot accept or agree with the terms of service for this website and discussion board, you are advised not to post on this board. In closing, I would like to remind you once again that it is still legal, in this great country of ours, to express a PERSONAL OPINION, as long as it is presented as opinion and not as fact. And finally, all you scammers out there will do well to remember that TRUTH IS AN ABSOLUTE DEFENSE against charges of libel, defamation, and slander... so if you're operating just a hop, skip, and jump ahead of the law, you might want to think twice before doing anything stupid... (AND SHAME ON YOU!!). |
