If the original note is sent to a random or harvested address, it's spam. Just because some of the recipients ask for more information doesn't mean you haven't spammed all of the recipients. It even has a name in the admin community: two stage spam.

If the original list consists of those you have permission to email, then it is legit. If you're only going through this sneakiness in an attempt to reduce spam complaints, it is not legit. Sooner or later an investigator will reply to the initial email to see who is behind the spamming. Most providers know about two stage spam, and you can still lose your web site. Many MLM companies have woken up as well and have written in a prohibition for this style of spamming.

As I said, it all depends where he got his original list of recipients. Harvesting from on-line ads and then pitching YOUR opportunity at them is not legit.
If you think your guy is justified in doing what he's doing, I'd love to know who the company is that allows this.
