My facts come from seeing how some ISPs and domain registrars like GoDaddy operate. My opinion is that all providers should operate to these highest ethical standards, and alas, many don't.

But the operation of some of those providers is no opinion. It's verifiable. One off-topic posting to this forum from Taiwan resulted in the Canadian domain owner almost getting shut off by GoDaddy, until they paid a significant fee and signed their "never spam again pledge."

Forum spam, violating MaaMaw's posted rules, not even email spam. One posting. $199 fine. It's a fact. Even one future spam and the domain gets confiscated and locked until it comes up for renewal.

Anybody violating those "best practices" is running a risk. Spamming doesn't always cost you your domain name, or hosting, or DSL connection - but it can.

MaaMaw's own host posts this as part of their AUP, besides the normal no-spamminng clause:

4.1.9.

you agree not to collect, attempt to collect, publicize, or otherwise disclose personally identifiable information of any person or entity without their express consent (which may be through the person or entity's registration and/or subscription to your web site or email list, in which case you must post a privacy policy which discloses any and all uses of information that you collect) or as otherwise required by law, and you shall maintain records of any such consent throughout the terms of this agreement and for three years thereafter;

See the reference to a "privacy policy" and "maintaining records" ?

That's the facts of today's hosting contracts. If you collect addresses, even of customers, you have to post a privacy policy stating what you intend to do with the addresses, when they're collected and in the future. If your privacy policy states you can change it at any time in the future, and post the modified one, then you're covered if you want to repurpose your list. If you failed to post a privacy policy, or didn't mention that you might change it in the future, then your use of any addresses you collect is LOCKED IN to the original purpose if you're at a host that has such an AUP.

Of course, you might not be at such a host, or you might be lucky enough that nobody complains. But you *have* violated their AUP if you repurpose your address list without having a corresponding privacy policy - and violating contracts is an ethical problem (my opinion!) and can get you sanctioned by the host (a fact!)
