And they expended a lot of effort sending you stuff that often you weren't interested in, in the hopes that you'll buy something. It's like television ads. Very few people stay glued to them, and when you're watching a program on DVD or Tivo, most people will fast-forward through the ads.
Much to the annoyance of the vendor.
We live in a world of information overload -- and it's almost to the point where it's information pollution. The spam mail tactic is even more information overload, and at its worst it overflows mailboxes, causes people to miss messages, and wastes the reader's time. It enriches offshore scam-bags who will sell "targeted lists" to suckers who will fork over money to try and promote their latest MLM or ebook or whatever.
What the "mailing list" risks is that customers will tell you "oh, go away" (sometimes with spam complaints) or will delete your email unread (because you're sending Yet Another Fluffy Article)... right before you send out an offer that they WOULD have bought.
Or you may carry someone for years who nukes the email and never reads it. That's a complete waste of your effort.
The BBS here is what replaces the function of a mailing list for YOU. Doing mailings would be ineffective and would work against you. The BBS is a "pulling ad"... people come here because they want to and because they're seeking information; it's pulling them in.
If you pushed the content at them, they'd probably hunt you down with axes and arrows. But you're pulling them in, and that makes all the difference in the world.

Do yourself a favor and turn your legal team loose in greener pastures.
