Getting falsely accused

In Response To: What kind of garbage?? (MaaMaw)

I have no spyware (and virtually no-popups either) on any of my sites

I have no adware or spyware in any of my software

Yet I probably get at least 1 email per month, accusing me of this.

Why?

1. Spyware/Adware works often like this:

(a) You get it on your computer
(b) The spyware/adware program run quietly in the background, usually every time you start your computer
(c) When you visit some OTHER site, the hidden spyware/adware program detects you are at a targeted URL, and pop-ups adverts when you visit this OTHER site.
(d) Many people often blame the site where the pop-up is shown (which of course has absolutely NOTHING to do with the spyware/ad-ware and doesn't even contain pop-ups in its HTML), for the pop-ups.

2. I offer a free trial/limited-version of our eBook Compiler and eBook Cover Creation programs. They do NOT force you to pay. They do NOT even remind you to pay. You just click "Register" if you want to pay for the full version, but you have as long as you want, without ANY reminders to try it before deciding whether to click "Register".

But what happens? People seem to often download a whole bunch of programs that also create ebooks or ebook covers, and apparently some of these programs may include annoying reminders. And then, they forget which is which, and you can imagine the rest.

3. I got several very nasty emails last year accusing me of all kinds of stuff, apparently related to spyware. This was a total mystery to me. When I got the first one, I thought it was some nutter. When I got a couple more, I started to wonder.

It was only after several months that I found out why...

Apparently one of the anti-spyware programs that diagnoses spyware, was generating FALSE positives (in other words it was claiming to have found spyware when none was present).

And why? Apparently this program was generating false positive on the basis of **FILE NAMES** (!!). One of our file names just happened to be the same as a file names as some file that this company had associated with spyware, and as a result ANYBODY who happened to have a filed called this particular name got diagnosed as a spyware propigator!

In other words, if you created a file called ABCDEFGH.XYZ (it wasn't this, but I can't remember the particular file name off the top of my head), WHATEVER was in the file, even if it was totally innocuous, you were assumed to be a spyware propigator!

As you can imagine, I was pretty annoyed.

On the good side, when I did finally figure this out and contact the company (a big name company), they did actually rectify the problem (at least for the file names in question for our particular case, I have no idea what else they might diagnose as spyware) fairly quickly.

Anyway...

As for this lady, I have no idea whether any of the above might apply to her complaint... but I imagine that it's possible

NOTICE TO SCUMBEEZLES
(you know who you are... you scream "Foul!" when the truth comes out)
PLEASE READ THIS LEGAL NOTICE CAREFULLY BEFORE YOU FILE A LAWSUIT OR EVEN WASTE TIME THINKING ABOUT IT.  It has been done before, but never successfully.  In fact, the last dodobird who tried it ended up being ordered to pay more than $77,000 in attorney fees ($65,000+ to my attorneys and $12,000+ to my co-defendant's legal advisor).
If your attorney is worth his salt, he's going to tell you that the expense of filing a lawsuit you can't win is a whole lot worse than any "damages" resulting from messages posted on this insignificant little chunk of cyberspace.
NEWS FLASH:  I didn't just climb down off that ol' turnip truck yesterday.  I'm well aware that expressing a negative opinion, relating one's personal experience, and restating provable facts are all legal in this country and do not constitute libel, slander, or defamation -- so you don't want to play games with me, and you sure don't want to start something you aren't prepared to finish.  I don't take threats lightly, and I don't accept bribes (or did you call it a "mutually-beneficial arrangement"?).  I'll turn you in faster than you can yell, "ARREST ME, I'M SCUM!!"
Do yourself a favor and turn your legal team loose in greener pastures.

By posting messages and/or content on the Friends In Business (Scams 101) Message Board, you give permission for Lesley Fountain/Friends In Business/Shoestring Success Publications to display, distribute and use the posting and content for publication, advertising, promotion, excerption or example.         In closing, I would like to remind you once again that it is still legal, in this great country of ours, to express a PERSONAL OPINION, as long as it is presented as opinion and not as fact.
And finally, all you scammers out there will do well to remember that TRUTH IS AN ABSOLUTE DEFENSE against charges of libel, defamation, and slander... so if you're operating just a hop, skip, and jump ahead of the law, you might want to think twice before doing anything stupid... (AND SHAME ON YOU!!).
