Well, OK, but...
Spam isn't about content. It doesn't matter what's IN the email or who sends it. If they don't have your prior informed consent to be sending it, it's spam. It depletes a scare resource - your time to deal with it.
The fundamental problem is that unsolicited bulk (not personalized) email doesn't scale. There are over 20,000,000 small businesses in the US alone who would LOVE to send each and every one of us JUST ONE EMAIL and ask us to opt-out if we don't want more.
If just 1% of those 20,000,000 businesses just sent one email apiece, spread out over a 365 day year, you would be hitting delete over 20 times an HOUR. 24 hours a day - DEL - DEL - DEL - DEL....
Take a week off and could you catch up with the spam?
Accepting unsolicited bulk (not personalized) email from FIB readers works until you have 100,000 readers, or got to be a guru yourself and then you have 1,000,000 loyal readers! See? It doesn't scale.
And if a process fails to scale, should you wait until it's totally out of control to try to get it back under control by setting some rules? No. I got outraged at getting a single spam a day in 1995 because I could easily predict the way the world had started to slide, and started fighting back.

I don't take threats lightly, and I don't accept bribes (or did you call it a "mutually-beneficial arrangement"?). I'll turn you in faster than you can yell, "ARREST ME, I'M SCUM!!" Do yourself a favor and turn your legal team loose in greener pastures.
