Kiddies, I allowed myself to get sidetracked for a few minutes while I read about republishing works in the public domain (hey, it's bathroom reading, okay??).
It says you're absolutely safe with anything published prior to 1923.
And it says you're safe with over 90% of anything published between 1923 and 1958 because the copyright was most likely never renewed...
but it's important to "do a copyright search" in order to be certain.
Which brings me to my question (and the crowd cheers):
It has always been my understanding that ALL your original work is copyrighted, whether you register it with the Copyright Office or not, as long as you type "Copyright" (or ©) and the date on it.
Was that not the case back then? Did you have to register your copyright in order for it to be valid?
If not -- if it was the same as it is now -- how do you know that a quarter of a century later, the author did not republish his work and simply not register the copyright??
What's the value of searching the Copyright database if a copyright does not need to be registered to be valid?? I know it's highly unlikely, but it seems to me one could get one's hiney skinned in short order if one missed a new edition that was never registered.

P.S. Also something of which I was not aware -- not all government publications are in the public domain. How do you know? Is it safe to assume if there is no copyright notice, they are not copyrighted?
