Hello everybody,
I'm not spending nearly as much time online now as I used to; I'm having too much fun creating products! But this one is way too important to stay offline.
Microsoft has issued a press release to announce their campaign against cybersquatters that infringe on their intellectual property.
Here's the link (I've re-posted it in my allocated "live link" space):
http://www.microsoft.com/presspass/features/2006/aug06/08-22domaindefense.mspx
For those who have been around Internet Marketing for a while, you will probably recognize one of the names.
Here's my question: How many times have you heard people suggest that you purchase domain names that contain the intellectual property of other companies? Did you even know about the Anticybersquatting Consumer Protection Act (ACPA)? And did you know that "ignorance of the law" or "that's what so-and-so told me to do" make poor excuses in a court of law?
Here's what I think is the most important lesson: choose your advisors carefully. There are LOTS of unscrupulous individuals out there who will tell you to do all sorts of crazy, stupid things. It may make you some money -- for a while -- but when their advice turns out to be illegal and companies with power and cash (like Microsoft) come after you to take back their domain names and seek damages, what will you do then? Ask for your $47 back?
Here's a good test: send your potential advisor an e-mail that asks their advice about something that is questionable or downright illegal, then see how they respond. That should be a pretty good indicator of their character -- and you want to choose ethical advisors. It pays in the long run.
If their response is "hee-hee, go for it", then add their address to your spam filter.
As everybody who's been here for more than a day is fond of saying: if something doesn't seem right, RUN!
I'll be looking forward to reading your comments the next time I'm online (currently scheduled for September 17, 2006 between the hours of 10:17 - 10:23 P.M....).
Thanks for listening,
Tom

PLEASE READ THIS LEGAL NOTICE CAREFULLY BEFORE YOU FILE A LAWSUIT OR EVEN WASTE TIME THINKING ABOUT IT. It has been done before, but never successfully. In fact, the last dodobird who tried it ended up being ordered to pay more than $77,000 in attorney fees ($65,000+ to my attorneys and $12,000+ to my co-defendant's legal advisor).
If your attorney is worth his salt, he's going to tell you that the expense of filing a lawsuit you can't win is a whole lot worse than any "damages" resulting from messages posted on this insignificant little chunk of cyberspace. NEWS FLASH: I didn't just climb down off that ol' turnip truck yesterday. I'm well aware that expressing a negative opinion, relating one's personal experience, and restating provable facts are all legal in this country and do not constitute libel, slander, or defamation -- so you don't want to play games with me, and you sure don't want to start something you aren't prepared to finish. I don't take threats lightly, and I don't accept bribes (or did you call it a "mutually-beneficial arrangement"?). I'll turn you in faster than you can yell, "ARREST ME, I'M SCUM!!" Do yourself a favor and turn your legal team loose in greener pastures. If you cannot accept or agree with the terms of service for this website and discussion board, you are advised not to post on this board. In closing, I would like to remind you once again that it is still legal, in this great country of ours, to express a PERSONAL OPINION, as long as it is presented as opinion and not as fact. And finally, all you scammers out there will do well to remember that TRUTH IS AN ABSOLUTE DEFENSE against charges of libel, defamation, and slander... so if you're operating just a hop, skip, and jump ahead of the law, you might want to think twice before doing anything stupid... (AND SHAME ON YOU!!). |
