Agreed. Specifically, Spam Arrest is on my doodoo list because when they first started out, they snagged and retained the email addresses of all people they issued challenges to. Not their USERS, but the innocent people who just wanted to contact their users. Then, they SPAMMED that list trying to get more customers. That got them widely blacklisted, a change in policy, and a lame apology from their president. I argued that a business in the spam-blocking industry should have known better than to do what they did, and I see no reason to ever let them out of my filters. Clueless and greedy from Day 1.
More philosophically, challenge/response systems are poorly thought of in the network admin commmunity. Most spam is sent with a forged "from" address, and a C/R system believes any incoming mail can be replied to, so it sends its challenge to an innocent address. That's not a problem until thousands of users deploy C/R systems and then a spammer forges YOUR address onto a million emails. You get 10,000 or 100,000 challenges to emails you didn't send, and I think you can see the problem. The C/R user is sitting fat and happy behind their shield, but the ricocheting bullets are spraying innocent addresses all over the net with their backscatter. Backscatter is in itself another form of spam.
Get good filters, but don't be responsible for adding to the amount of unsolicited bulk email floating around out there, I advise.

Do yourself a favor and turn your legal team loose in greener pastures.
