1. First thing I would do is get a hold of your credit report to see if this supposed delinquency is on there. It should be on there if this is really legit.
2. I believe in PA, the statute of limitations for collecting a debt is 4 years. After that, you are scott free. If I am right, however, this being a debt from NJ may make things different.
3. I would go to http://creditboards.com/forums/index.php and as questions there. They will be able to tell you how to proceed with this effectively.
4. I'm not sure what the collector means by a "summons" however if he is insinuating that he will have you arrested, relax, he cannot have you arrested for not paying bills (unless they are tax bills). There is no such thing as debtors prison. To get him to stop harassing you you need to send him a properly worded C&D letter. The folks on the forum I mentioned will be able to help you here. No need to get a lawyer. There are form letters out there you can use where you just fill in the blanks.
It may very well be since this guy has all your info that somehow that salesman in NJ put the order through in your name and used the phone himself as long as he could without paying. This is fraudulent but it could happen and sounds like it did. In this case, you are SOL so you have to actually act on this in order to clear things up.
