Because of the phrase "Attention eBay" in the wording, I'm pretty sure he has that disclaimer in the ad to comply with a policy that eBay had until a short time ago. The policy was that you couldn't sell any downloadable product unless you were the actual copyright holder. Having resale/reprint rights didn't qualify as being the copyright holder as far as eBay was concerned.
If I'm not mistaken, that policy changed two or three months ago as part of a general rewrite of eBay's download product policy, so it's very possible he'd remove if you asked him to and pointed out it was no longer required.
Your post does bring up an interesting point about copyright though.
Between one and two years ago I sold what were called "private label rights" for an ebook I'd written about buying ebay inventory at garage sales to 30 different people.
A small group of the buyers broke the book down by chapter and used it as content on their web sites which I'm sure are copyrighted.
Most of the buyers changed the title and are selling the product in ebook format.I've never purchased one of the books, but my guess is that most, if not all, these buyers made no changes to the actual content so, although the titles are different, I'm guessing the content of each book is nearly identical.I'm also guessing each of the books is copyrighted.
So, who actually owns the copyright to the material?
Me? All of us? Some of us?
It doesn't matter to me because I have no plans of selling the book myself, but it does pose an interesting question.
