Don't see how this could make many happy.

In Response To: FTC Proposes New Business Opportunity Rule (Woody Quiñones)

Among other requirements is the release of names and addresses of all of your other members / customers / affiliates / associates / whatever you want to call them. You must as a minimum disclose the names and addresses of the 10 closest to the new prospect.

This sort of assumes that those 10 people want their names made public. With all of the spamming / scamming going on, that might not be a correct assumption. Sign up and lose your privacy.....

Many of us are affiliates of some sort of program or another. Those affiliate programs are "business opportunities" and subject to this rule. This thing is all-inclusive. If you offer someone the chance to make money, other than by a regular paycheck, you are subject. And there is no minimal threshold, not even $ 20 or $ 25. Even free, you have to make these disclosures.

This is a late posting on this rule, here on FIB On many forums where it has been discussed, it is overwhelmingly viewed by small business people of all types, and their attorneys, as a disaster. A few have said "I've got nothing to hide.", but thqt is not the point. There will be costs involved. Prices will very likely go up. Catalogs, price sheets, websites, sales literature will all have to be revised - at a cost.

And, considering the governments "nose under the tent" way of getting involved in more and more ways with our lives, this is could be just the start. Keep in mind that this is being proposed by an administration that is not known for being on the side of the small business owner, nor the "common man."

It's hard for me to imagine anyone in business welcoming something like this. It's going to affect Dennis Bevers and K&B. (Sorry Dennis.) Two totally respectable operations, but still covered by the rule. And K&B may have to raise prices as a result.

It's going to cause SMC to release thousands of names and addresses to anyone who inquires about their opportunity. And as I mentioned several times here, I sell a $ 25 "starter kit", that I now won't even be able to give away, without disclosing information.

I don't disagree with the intent, but I do feel like there should be a specific dollar figure involved before it goes into effect. Unlike the Franchise Rule with $ 500, maybe $ 100 would work.

Here is a link to the whole thing. The actual proposed new rule starts on Page 35 of the pdf file, under - Section L - Proposed new rule.

NOTICE TO SCUMBEEZLES
(you know who you are... you scream "Foul!" when the truth comes out)
PLEASE READ THIS LEGAL NOTICE CAREFULLY BEFORE YOU FILE A LAWSUIT OR EVEN WASTE TIME THINKING ABOUT IT.  It has been done before, but never successfully.  In fact, the last dodobird who tried it ended up being ordered to pay more than $77,000 in attorney fees ($65,000+ to my attorneys and $12,000+ to my co-defendant's legal advisor).
If your attorney is worth his salt, he's going to tell you that the expense of filing a lawsuit you can't win is a whole lot worse than any "damages" resulting from messages posted on this insignificant little chunk of cyberspace.
NEWS FLASH:  I didn't just climb down off that ol' turnip truck yesterday.  I'm well aware that expressing a negative opinion, relating one's personal experience, and restating provable facts are all legal in this country and do not constitute libel, slander, or defamation -- so you don't want to play games with me, and you sure don't want to start something you aren't prepared to finish.  I don't take threats lightly, and I don't accept bribes (or did you call it a "mutually-beneficial arrangement"?).  I'll turn you in faster than you can yell, "ARREST ME, I'M SCUM!!"
Do yourself a favor and turn your legal team loose in greener pastures.

By posting messages and/or content on the Friends In Business (Scams 101) Message Board, you give permission for Lesley Fountain/Friends In Business/Shoestring Success Publications to display, distribute and use the posting and content for publication, advertising, promotion, excerption or example.         In closing, I would like to remind you once again that it is still legal, in this great country of ours, to express a PERSONAL OPINION, as long as it is presented as opinion and not as fact.
And finally, all you scammers out there will do well to remember that TRUTH IS AN ABSOLUTE DEFENSE against charges of libel, defamation, and slander... so if you're operating just a hop, skip, and jump ahead of the law, you might want to think twice before doing anything stupid... (AND SHAME ON YOU!!).
