I'm so sorry... it's been a busy week and I didn't see your question till I did a more thorough read of the board today.

Earthlink is right and you are right, too.

Here's what happened: you didn't have a hacker, but Earthlink DID have an equipment failure on that computer. You see, Earthlink has a "web farm" of hundreds of "boxes" that host all their free pages and they have a big team of geeks taking care of them. Occasionally one of their web farm machines goes down because... well, hardware goes down. We've all had computers die for various reasons.

They do back up their machines (unlike many folks). However, they're not backing them up once a minute, but once a day (some critical ones are backed up at a once-every-several-hours schedule and are mirrored.) Yours was on the "we back it up on a longer schedule" server.

So your server went boom!

The site manager shrieked as soon as someone notified them saying "my site is gone!" (or sooner) and roared at some poor tech to get out there and Fix It Now. They did, but the drive itself was damaged and they had to put in a new one and then restore everything.

The last backup they had was done while you were working on your site.

...and that's why you ended up with a half-finished site again.

I recommend to folks that they keep an archive of their sites (I have several) so that they can restore to the latest and greatest version if this happens. It's not terribly uncommon, but folks don't expect it.

A good backup on YOUR machine (burn it to CD, please, because your machine can go FOOMP!, too, you know) is something that's very critical for maintaining a website.

So they didn't have a hacker but they did have hardware (hard drive) failure. Webhosts generally don't admit this unless you happen to have enough tech knowledge to spot the symptoms and ask directly about this (and sometimes the morning manager doesn't get the memo about what went down from the night or evening supervisors.)
