Go ahead, sue, me! You can't take what I don't have!!!!!!

Just wanted to point something out here that I see all over other forums.

Now, I am not a lawyer or any type of legal professional so this is just pure guesswork on my part. So please so correct me if I'm wrong. But here's the situation. Many of us have heard it at one point or another.

Here's how it goes. Some poor fella is doing something that is against the law. Let's say that for this scenario it is trademark infringement (or whatever you call it).

People will tell said poor fella "You know, you better watch out. You'll get sued for hundreds of thousands, if not, millions of dollars and then you'll be even more poor than you are now.

Poor fella replies with that ever-so-famous "Hey, let 'em sue me. Afterall. I don't have a million bucks so they can't take from me what I do not have."

But there is a great flaw in that line of thinking as far as I can see (but as I said, please correct me if I'm wrong).

Although you are so poor that you have nothing, if a company or person is awarded a judgement over you in a court case, they can still get the money from you. What they will do is have your wages garnished. Now, by law, I believe, they cannot have more than 25% of your wages garnished. But consider this. If you are damned by the court to pay the defendant, say, $1 million, then for the rest of your life you will have 25% of your wages garnished. 25%!!! That's nothing to scoff at. Not only will you be paying the settlement for the rest of your life, but you'll always have that dreaded mandatory deduction from your paycheck and that alone will ruin you financially forever, especially if you make jack squat as it is. It could force you to have to get another job.

So, the poor fella will say, "So what. I won't pay it." Bull crap! If you do not abide by the law and have your employer deduct it an have it sent to the receiving party, you will find yourself in jail faster than you now it.

So don't be a tough guy. Don't screw with people and companies that have more money than you. Just because you are already poor and don't have a million dollars it doesn't mean that you are scott free. On the contrary, you will be worse off than you would have been if you actually had the million dollars to pay out in a lump sum.

So, am I wrong? Seems to me that if it were that easy to get out of paying a settlement awarded to the defendant by the court there would be a great increase of poor people infringing on the rights of the rich.

Love to hear everyone's thoughts, especially those with experience in this matter.
