Hello all,
I have been a member here for about a year and a half. I don't post often.
Only if I think I can help or if I have a question. I don't want to waste
anyones time. However, tonight I have a delimma that is really driving me
crazy. I am hoping someone can help me out. And NO, it is not exactly
business related, so Mamaaw, I don't blame you if you delete. But I'm really
hoping to find someone here with some "background" in this situation.
May be a long story. Here goes:
I recently met my husbands ex-wife and daughter in June of this year.
Wonderful people and I accept the ex-wife as my friend. (it's been 13 years)
Anyway, She has been living in her mothers house for atleast 18 years. Raised
her daughter. And "paid rent" to her mother to help her buy her medication
that she needed. Her mother died 2 months ago. She was hoping to "homestead"
the home and get it in her name.
Now, tonight, I find out. Her sister, (who is well-off) calls her and tells her
that they have to meet with an attorney next Wed. And the reason she cannot
have the home put into her name, or "homesteaded" is because of $20,000
in medical bills in her name for her daughter.
Now, If this is an inheritance. In Bay County Fla. What legalities hold
the real estate that the property cannot be transferred into her name?
Maybe she can't get a "homestead" excemption on it. But shouldn't she still
be able to obtain the property into her name?
I'm sorry for posting this here. But I trust the people here. I have already
done a google search for every term I can think of and I can't find anything!
This woman and child should not have to fight for the home they have lived
in for 16+ years!
Any comments/research would be very greatly appreciated.
Thanks,
Angela

PLEASE READ THIS LEGAL NOTICE CAREFULLY BEFORE YOU FILE A LAWSUIT OR EVEN WASTE TIME THINKING ABOUT IT. It has been done before, but never successfully. In fact, the last dodobird who tried it ended up being ordered to pay more than $77,000 in attorney fees ($65,000+ to my attorneys and $12,000+ to my co-defendant's legal advisor).
If your attorney is worth his salt, he's going to tell you that the expense of filing a lawsuit you can't win is a whole lot worse than any "damages" resulting from messages posted on this insignificant little chunk of cyberspace. NEWS FLASH: I didn't just climb down off that ol' turnip truck yesterday. I'm well aware that expressing a negative opinion, relating one's personal experience, and restating provable facts are all legal in this country and do not constitute libel, slander, or defamation -- so you don't want to play games with me, and you sure don't want to start something you aren't prepared to finish. I don't take threats lightly, and I don't accept bribes (or did you call it a "mutually-beneficial arrangement"?). I'll turn you in faster than you can yell, "ARREST ME, I'M SCUM!!" Do yourself a favor and turn your legal team loose in greener pastures. In closing, I would like to remind you once again that it is still legal, in this great country of ours, to express a PERSONAL OPINION, as long as it is presented as opinion and not as fact. And finally, all you scammers out there will do well to remember that TRUTH IS AN ABSOLUTE DEFENSE against charges of libel, defamation, and slander... so if you're operating just a hop, skip, and jump ahead of the law, you might want to think twice before doing anything stupid... (AND SHAME ON YOU!!). |
