I don't what it's like now. My experience is seeral years old, so they might have changed. If I were you, I would explain to the client and go ahead with the filing -- but don't get their hopes up. That way, when ICANN comes through, you'll be in the catbird seat.

Domain name selling used to be VERY big about 5 years ago, and no, it doesn't matter the size of the company. They might not hae targeted your company specifically. One little darling ran around buying up all the .com names of every city in Texas (or nearly every one) and tried to resell them for $5,00/name. Some paid, some didn't. Last I tried to get our dot-com name from him (three years ago) he wasn't responding but had somehow managed to lock the name up with himself as the sole registrar. We elected to register another name.

We also had an ex city council person register our city's name (I can't remember if it was "citynametx" or just "citynametexas" or what.) He wanted money. When we didn't buy from him, he set up a very short-lived site criticizing the city.

A local photographer snagged one variant of a local festival name.

...and so on and so forth. I also helped an actor recover his name from a fan (basically outwaited her.)

Nope. They bought a different name and never looked back.
