*****Don't tell them upfront you'll refund overages, just do it. Think of what a nice surprise it will be for the customer and how much loyalty that will buy. Just give them the price and let them pay. Then knock their socks off with the refund check. Even small amounts would brighten their day, even more so if there is a nice note with it.
Or don't "charge" for shipping. Build it into the selling price and again, a lot of people will love getting "free" shipping.
But I prefer the refund method. I think having a company send a refund check and a note saying "Oops, we overcharged you for the shipping and want to get your money back to you" shows 1.) class, 2.) serious consideration for the customer and 3.) integrity. Manners go a loooooooooooooooooooooooooooooooooong way in smoothing things over in Life and the nicer companies are to me, the more loyal I am to them. AllWebCo is a great example. There are other webhosting services that might be cheaper but I stay with AllWebCo because of the fantastic customer service and the friendliness of the people working there. (To people who don't know about AllWebCo...their prices are great but technically, there are cheaper places. But I'd be willing to bet NO ONE beats their customer service.)

Do yourself a favor and turn your legal team loose in greener pastures.
