The first thing you do is contact their ISP *and* their webhost and file a copyright complaint letter (basically it goes, "I am contacting you to report one of your members, who has stolen my copyrighted material and is attempting to pass it off as his own.") You tell them when your original site was put up and when you wrote the books and point them to your site. Add that you are pursuing legal efforts in this as well.
Contact the thief as well and give them a polite "cease and desist" letter. Don't pretend to be a lawyer and use plain English. Tell them that your site did not give them permission to copy the material and to sell the books as their own and that they were not public domain books (I'm assuming you're not offering something like Napoleon Hill's "Think and grow rich" or other classics.) Tell them you are giving them a week to remove it or you will pursue complaints with their ISP and webhost and ask for their account to be removed.
CC that to the webhost and ISP.
Most folks will back down at this point.
If not, proceed with the formal request to the webhost and the ISP to remove the site. Sometimes you have to go to the upstream provider, but not often. Most folks will back down if you give them a polite request.

Do yourself a favor and turn your legal team loose in greener pastures.
