They claim they're legal, for the tiny bit of value in the claim. From their FAQ:
• Are lottery clubs and pools legal?
Yes. States with lotteries recognize lottery clubs and pool playing. Lotto Magic does not sell lottery tickets. Only retailers who have been contracted by the Florida Lottery Commission are authorized to sell tickets. Lotto Magic promotes lottery club play with our computerized system to enhance our club member’s chances of winning. If there are no lotteries in your state, this may be your only way to play the lottery.
• Doesn’t the United Postal Service have rules regarding lotteries?
Yes, several are in the US Code. Sec.3005 regarding lotteries has been on the books for about 50 years. Lotto Magic is not conducting a lottery -- we are merely a club buying tickets for our members in the Florida lottery. Another statute frequently referred to is Sec.1302 - Mailing lottery tickets or related matter. We do not mail any lottery tickets or Florida Lottery materials through the mail.
• How do I know that you are an honest company?
If I knew what I could say in answer to that question to convince you, I would be the wealthiest man in world history! I can only say that we have operated Lotto Magic since January 1996 and have purchased every ticket we claimed. In fact, copies of these tickets (the originals have to be turned in each month to claim the winnings) are all still in our fireproof safe just in case we have to prove that one day!
But I just have to ask: why participate in an opertation like this at all? Do you have some urgent need to send money away to Florida to support their schools, etc.? IMHO (and a lot of others), lotto, lotteries, and state-run numbers games are a thinly disguised moron tax.
