Hi and thank's for the advise. We did EVERYTHING down to the letter because his boss was giving him a hard time at work. I would have to get into the whole long story and I think it would bore you to death. Short story is when she doct his pay an hour for giving blood at a blood drive his company was giving and no one else got did I called the equal employment comission and they jumped all over her.It stated in the handbook that ALL employees got paid while giving blood. she said it was because he had already taken to much time off that week and he was supposed to ask her for permission. He WAS still working at the time under FMLA he was just taking up to an three or four hours a week off to take me to appointments then either going into work late or going back to work depending on the time the appointment was. (does that make sence) And to clear that up YES he did tell her ahead of time when he needed to take the time off it was like he would go in and say look I have to leave in an hour. They new at least a week ahead of time. The thing is we don't know why she fired him. She said that his accounting practices (he worked in accounts payable paying literaly millions of dollars in bills every week) weren't living up to their standards. He worked there for 3 years with a total of 6 mistakes in the whole time he worked there, and they were all in the first 3 months of when he started. (He actually for all intent and purposes, worked there 4 1/2 years but we had to move to Texas for a year when his Grandfather died to help care for his Grtandmother. When we came back he was hired right back on the spot!! By a different boss)
The hard thing is that we live in Maine and it is a free will state. That means if your boss doesn't like that color of your hair they can fire you. I haven't spoken to an attorney yet but I am really thinking about it now, because he called the PH department to see if they could at least tell him WHY he was fired (you know if he made a BIG mistake or what have you) well the woman that fired him never gave the reason. He tried to colect unemployment and here in Maine they do what is called a fact finding interview on the phone were they case worker calls both party's and gets both sides of the story well she got my husbands side and tried, I think she said in her letter 4 times, to get ahold of the other party and never got an answer back. So I am going to take all of this and find an attorney and see if there is something we can do. But like I said we live in a free will state so I don't know if it will work. (I know this sounds awful but This company that he worked for is a MAJOR company here and they are all about "family values".Wouldn't the media like to get their hands on this one.)
