The rules as I understood them would actually prevent a lot of sales and I was really amazed that eBay took that broad stance on the matter. Granted there are liabilities involved but think about it.
The first time I read that section of the rules the first things that came to my mind were:
1. How can anyone now sell used books on eBay? Unless they are the copyrights holder can't eBay pull the ads?
2. How can anyone sell used software that they have and no longer need. Think about that one. You buy Frontpage 2003 to replace your old 2000 version. You decide to go ahead and sell your 2000 version and, in keeping with the MS agreement, you delete 2000 from your pc when you install your new version. You put the 2000 Cd back into its case which will allow its new owner to use that old registration number to install it and are ready to place a quick ad on eBay. But you can't. You aren't the copyright holder; MS is.
I am left asking if perhaps this rule is open for interpretation somehow. People selling things that they have a full and legal right to sell should be allowed to do so as long as they don't infringe on the rights of anyone else when they do. That is so long as the item(s) don't openly violate some of the more obvious rules. (weapons, explosives, virginity, and that sort of thing)
What's your overall take on it Gary? Can someone still sell their old copy of MS FP 2000?
